Hecktic Media Incorporated (“HMI”) is the owner and operator of the website, HeckticMedia.com (the “Site”). By using and reading the Site, you indicate that you accept the terms of use below along with our Privacy Policy, incorporated herein by reference, and that you agree to abide by them. Please note that we may revise the Terms of Use at any time. If you do not agree to the Terms of Use or any revisions to it, please discontinue your use of the Site.

1.1  The materials and information contained on the Site are provided for general information purposes only and do not claim to be or constitute legal, financial, real estate, medical or other professional advice. The information shall not be relied upon as such and you should seek trained professionals for expert advice. Neither HMI, nor its subsidiary or affiliate companies or their respective officers, directors and employees accepts any responsibility for any loss which may arise from accessing or relying on the information on the Site. To the fullest extent permitted by law, we exclude any and all liability for injury, loss or damages, whether direct or indirect, arising from use of the Site.

1.2  HMI or our licensors are the sole owners of all intellectual property, including logos, images, illustrations, audiovisual works, photographs and text (“Materials”) on the Site. The Materials are protected by Canadian and international copyright and, where applicable, trademark laws and treaties. All rights are reserved. Materials may not be downloaded, reproduced or used for commercial purposes without the prior written permission of HMI or its licensors. You may download or print individual pages from the Site for personal, non-commercial use only, provided that you may not modify any information or Materials in any way.

1.3  We do our best to ensure that the information and Materials on the Site are up-to-date, accurate and relevant. However, occasionally some of the services provided or information and Materials on the Site may be incomplete or out-of-date. The services provided and information and Materials displayed on the Site are provided without any guarantees, conditions or warranties as to their accuracy or completeness. To the extent permitted by law, HMI, our subsidiary and affiliate companies, and each of their respective officers, directors and employees, contractors and suppliers hereby expressly exclude any liability for any direct, indirect or consequential loss or damages incurred by any user in connection with the Site or in connection with the use, inability to use, or results of the use of the Site, any websites linked to it and any information and Materials posted on it, including, without limitation, any liability for:

– personal injury, illness or death
– loss of revenue or income;
– loss of business;
– loss of anticipated savings;
– loss of data; or
– loss of goodwill

1.4  HMI uses industry standard security precautions, however it is up to you to understand the risks involved in using the public Internet. HMI will not be liable for any loss or damage caused by virus attack to the Site or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any Materials, or on any website linked to it.

1.5  Where the Site contains outbound links to other third party websites, these are intended for convenience only. HMI makes no representations and has no control over the contents of those sites or resources, and accepts no responsibility for any loss or damage that may arise from the use of them. Please review those third party websites’ own terms of use and privacy policies.

1.6  You agree to use the Site only for authorized and legal activities. You may not use the Site to engage in threatening, abusive or defamatory behaviour or any activity that violates any law or third party right. You may not use the Site for any advertising, sponsorship or endorsement purposes which have not been prior approved by HMI. Without limiting any other rights and remedies it may be entitled to, HMI reserves the right, in its sole discretion, to terminate your access to all or part of the Site, for any violation of these Terms of Use or other claim in law.

1.7  These Terms of Use shall be construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of laws rules. You expressly agree that any claim or action arising out of or relating to these Terms of Use or your use of the Site shall be filed only in the courts of the Province of Alberta or the Federal Court of Canada, as applicable. HMI makes no representation that the Site or the products or services on it are appropriate for use in locations other than Canada. By choosing to access the Site from any location other than Canada, you accept full responsibility for compliance with all local laws that are applicable.

1.8  You agree to defend, indemnify and hold harmless HMI, its subsidiary and affiliate companies, and each of their respective employees, officers and directors, contractors and suppliers (individually and collectively, the “Indemnified Parties”) from and against any claims, suits, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of any third party claims relating to your use of the Site or your violation of these Terms of Use. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify the Indemnified Parties and you agree to fully co-operate with us with any such defence. You agree not to settle any matter without our prior written consent.

1.9  You have read and accept the terms of our Privacy Policy.

1.10  Some of the information or Materials on the Site may concern adult themes which occasionally may not be appropriate for children. The Site is not targeted toward children under the age of majority in the province or territory of residence. Children between the age of 13 and the age of majority may only use the Site if their parent or guardian consents to the Terms of Use on their behalf. Generally, we recommend that parents or guardians take an active role in their children’s use of the Internet.

1.11  These Terms of Use including the Privacy Policy is the full and final agreement between HMI and you with respect to the subject matters hereof and supersedes all prior agreements between the parties with respect to such subject matters. If any provision of these Terms of Use or its application is for any reason held to be invalid or unenforceable in any jurisdiction, the other provisions of these Terms of Use will remain in full force and effect. Any delay or failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. The word “including” used in the Terms of Use and the Privacy Policy means “including without limitation.” The relationship between the parties hereto is that of independent contractors and neither party is an agent or partner of the other.

Hecktic Media Incorporated (“HMI”) is the owner and operator of the website, HeckticMedia.com (the “Site”). As an internet-based business, HMI respects and recognizes the importance of your privacy rights.

This policy explains how we collect, use, retain and disclose the personal information that you provide us through the Site or our affiliate websites, or through the course of our other business dealings with you.

Please note that the Site contains links to other third party websites that are not operated or controlled by HMI. This policy does not apply to such third party websites and we are not responsible for the content on those websites or their privacy practices. We encourage you to review the terms of use and privacy policies of every website you visit.

In addition, please note that your personal information may be processed in the country in which it was collected, and in other countries including Canada and/or the United States, where laws regarding processing of personal information may be less stringent than other countries.

What is Personal Information?

“Personal Information” for the purposes of privacy law is information about an identifiable individual, such as their name, address, telephone number and email address. Personal Information does not include aggregated information that is anonymous, such as the type of browser you are using, or other non-personally identifiable information.

What information does HMI collect and why?

We collect different types of Personal Information at various points on the Site, depending on your relationship with us. If you are interested in subscribing to our newsletters, we will collect your name and email address. If you are entering one of our contests or participating in an interactive feature on the Site, we may also collect your city and province of residence. If you leave a comment or send us a message, you may also leave your name and email address. If you are one of our media, destination or brand partners, we will collect additional information including your mailing address, phone number, or other particulars necessary to complete the business transaction. If you are purchasing any merchandise, payment and processing is handled through a third party payment processor and related service providers on our behalf. Please refer to that third party payment processor’s own privacy policy to see how they collect and use customer information.

There are other types of non-personally identifiable information that we may collect on the Site.
The Site uses “cookies”. A cookie is a piece of data stored on the user’s computer about their usage patterns. The use of cookies and similar technologies allows us to identify repeat users, collect non-personal demographic information, and also administer and make improvements to the Site. You may instruct your browser to disable cookies for greater privacy however some services on the Site may not function as well if you do so.

In addition, we may also collect search queries that are typed into the Site’s search engine and retain them in anonymous form. An IP address is a number assigned to your computer by your Internet service provider so you can connect to the Internet or email. We may collect or use these to diagnose problems with our server or report aggregate information to improve the function of the Site. HMI, our subsidiary and affiliate companies and any third party as we may designate, may use, update, disclose or sell such non-personally identifiable aggregate information to third parties.

In addition, we may use third-party advertising and marketing companies to publish advertisements on the Site. These companies may use non-personally identifiable aggregated information compiled from your visits to the Site, so that these companies may serve advertisements about goods and services that may be of interest to you.

How do we collect, use, protect and disclose your Personal Information?

HMI requires your consent to collect, use or disclose your Personal Information, subject to certain exceptions in law.

Collection
We typically collect your Personal Information when you subscribe to our newsletters or submit an inquiry through the “Contact Us” form on the Site. If you are one of our business partners, we may also obtain Personal Information about you from other sources, e.g., from your business partners or other individuals within your company, or third party representatives or government agencies.

Use
HMI may use your Personal Information to send you our monthly newsletters; to conduct or administer contests or other promotions in which you have participated; respond to inquiries that you make through the Site; to receive feedback and make improvements to the Site; and to maintain a database of client information.

In accordance with Canada’s Anti-Spam laws, we will only use your Personal Information for marketing purposes with your prior consent. If you subscribed to our newsletter and no longer wish to receive it, you may unsubscribe at any time by following the “unsubscribe” instructions in our emails. Protection
HMI has a number of policies and procedures in place to protect your Personal Information, including physical procedures such as locks; administrative procedures such as contractual obligations by our third parties who may manage your Personal Information; and technological safeguards including the use of passwords, secured servers and firewalls. Only individuals who are involved in the administration of our operations have access to your Personal Information and they have been provided with the requisite training on our Privacy Policies.

Nevertheless, despite our best efforts, Internet or wireless transmissions are never completely private or secure. In that respect, you hereby acknowledge and accept the potential risk of inadvertent disclosure due to any such disclosure beyond our reasonable control.

In addition, please note some of our service providers may be located in countries where authorized government officials may lawfully be able to access your Personal Information without your knowledge or consent pursuant to the laws of such countries.

Disclosure
HMI may disclose your Personal Information to our subsidiary and affiliate companies and to third parties who provides services or perform functions on our behalf, including: support services, website services, contest administrators, and processors of credit card or online payments. We will only disclose your Personal Information to the extent necessary for these third parties to provide these specific services.
In the event that we sell a substantial portion of our business, please be aware that your Personal Information may be among the transferred assets. If this occurs, the purchaser of our assets will inherit the confidentiality obligations provided in this Privacy Policy.

Other than for the specific purposes set out in this Privacy Policy, HMI will not disclose your Personal Information to any third party companies unless we obtain your prior consent or are legally compelled to do so.

Privacy of Minors

HMI recognizes the importance of protecting the privacy interests of children and we encourage parents and guardians to take an active role in their children’s online activities and interests. The Site is not intended for children under the age of majority in their province or territory of residence and we do not knowingly collect Personal Information from minors.

Requests for Access and Correction of Personal Information, Questions or Comments

We welcome questions and comments about this Privacy Policy, as well as requests for access and corrections to your Personal Information. We will take reasonable steps to ensure your Personal Information is accurate and complete. Please be aware that due to back-ups or records of deletions, it may be impossible to delete Personal Information completely without retaining some residual information.

Upon request, subject to certain exceptions provided by law, we will inform you of the existence, use and disclosure of your Personal Information and provide you with access to same.
